摘要

平等接受高等教育是残疾人的基本人权

需要健全的法律制度予以保障。我国相关法律对残疾人的高等教育权的规定过于原则

操作性不强

具体法律保障制度严重缺失。因此

建议借鉴国外残疾人高等教育的先进经验和法律制度

加强立法的制度化

全面保障残疾人高等教育权的实现。

Abstract

The equality to accept higher education for disabled persons is the basic human rights.We need to improve the legal institutions to guarantee it.The concerning laws about higher education for the disabled are the simple provisions in our country

and lack of strong operability.Meanwhile

the specific legal system is deficient.We should draw lessons from foreign advanced experience and legal system of disabled higher education

strengthen the legislation and guarantee the realization of higher education rights for the disabled.The legal institutions of disabled higher education must embody the attributes of fairness of the national education.
