摘要

目前我国行政法理论和制度对行政相对人行为的效力极不重视

进而忽视了相对人行为对行政权的监督制约作用。相对人行为的效力基础是权利和法律。效力类型包括启动力、中止力、终止力、阻止力、影响力、产生力、强制力、支配力、形成力等。理论和立法必须在相对人行为效力与行政行为效力之间保持适度平衡。

Abstract

At present

the research on the force of administrative counterpart action is not valued in the theory and system of administrative law in our country

so that the surveillant and restricted function of administrative counterpart action is ignored.The force of administrative counterpart action is based on the rights and law.The styles of forces include starting force

suspending force

terminating force

preventing force

influencing force

producing force

compelling force

controlling force

forming force and so on.The theory and legislation must keep the moderate balance between the force of administrative action and counterpart action.
