《婚姻法》修正案、《最高人民法院关于适用〈中华人民共和国婚姻法〉若干问题的解释（一）》和《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》的施行

为侵犯配偶权案件中受害人请求精神损害赔偿提供了更多的选择途径

如何选择最佳途径使受害人得到有效补偿

是颇值研究的问题。

Abstract

With the implementation of “marriage law" amendment and “the interpretation of the Supreme People’s Court concerning some questions about how to decide the liability of tort for spirit damage"

there are much more selections for victims to claim compensation for spiritual damage. It is a question deserved to study that how to select the best ways to compensate victims efficiently. The article is to discuss some questions on characters

elements

and approach selection of claim right for compensation for spiritual damage. The author hopes it will benefit the theory and practice of marriage law.
