摘要

司法社会工作是化解家事纠纷第一道防线上的中坚力量，是推进家事审判改革不可或缺的元素之一。司法社工参与家事审判的路径可行且多样，其中社会工作者担任着诉前引导员、家事调查员、诉中调解员、判后关护员等重要角色。他们将法律的威严与对个人的关怀糅合在一起，提升了柔性司法服务水平，是一种适应我国现代化司法社会治理要求的巧妙融合。由于相关实践与研究尚处于起步阶段，司法社工在服务开展过程中也面临着诸多困境：社会工作者缺少专业的督导和培训，导致专业能力不足，目前法律上还没有赋予司法社工明确的法定身份，社会工作者存在一定的身份认同障碍；社会工作者并非能胜任家事审判的所有环节，需要和心理咨询师、志愿者等其他社会力量分工合作，社会工作者如何处理和他们之间的关系等。

Abstract

Since the pilot work on family trial reform was carried out in 2016

courts all over China have gradually started practical exploration. Judicial social work is the backbone of the work to resolve family disputes and one of the indispensable elements to promote family trial reform. There are diverse feasible paths for judicial social workers to participate in family trials

among which social workers play an important role: pre-litigation guide

family investigator

mediator in litigation

and post-trial caregiver

etc. Judicial social workers combine the majesty of law with the care for individuals

which improves the level of flexible judicial service. It is a clever integration to meet the requirements of China's modern judicial social governance. As related practice and research are still in the initial stage

judicial social workers are also faced with many difficulties in the process of service.
